Spouse applying for ILR but I have to apply for an extension

Post by SK1651 » Wed Sep 18, 2013 2:35 pm

Hi All,
I tried to look over the UKBA site and the internet for clear instructions but failed to find them in my case. I would really appreciate if anyone could provide any help with the same.

My husband is applying for ILR under PBS Tier1(General) category. Since I recently came to UK as Tier1(General) dependent and do not meet the requirement of completing 2 years in UK for applying for ILR with him, I have to apply for an extension. Both of us have visas till 8th November 2013. I have following questions to start with:

1. Which form should I use to apply? Can I apply with FLR(M) considering the application fees is reasonably less as compared to PBS Dependent or I have to apply using PBS Dependent only?

2. If my husband applies at PEO, can I apply in post after his decision is made or we need to apply together?

3. What are the documents needed for my application?

Thanks in advance.

If you became a dep spouse after July 2012 then the required period to wait is 5 years not 2. You can apply for FLR(M) once your spouse is settled but it could mean you have to wait 5 years from the time you are awarded FLR(M). Given you appear to have been here only for a short period that shouldn't be too bad.
