ILR 28 days Clarification - Entered after 3 months initially

Hi

I haven't seen a case like mine in this forum. Apologies if I have missed it.

First stamped - 20 Oct 2008
Entered to UK - 20 Nov 2010
After second extension I know if my visa expiry is at 20 Oct 2015 I cannot apply for ILR. But say my expiry date will be - 30 Oct 2015

Shall I apply for ILR 28 days before 20-Nov-2015 i.e 23 Oct 2015 though my visa expiry is before 5 years and I did not enter within 90 days initially.
