help in Switching from psw to Tier 2

Hi am switching from psw to tier 2 general, i completed Msc managemet in 2012, im working in company as production manager, with a salary of 21,000 pa
(SOC 1121) company got sponsor licence last week.

1. Can i apply for tier 2 general with this salary?

2. my visa is expiring on 18/12/13 so what will be the start date on SOC,
I have already started working in this company 2 years and 4 months but got promoted as production manager 4 months ago.. as i understand it cannot be past date, so is that ok if i put 19/12,13 even though i have started working in this company.

please help me in this matter i went to solicitor and she is saying i go under experienced worker so bit confused.
i really appreciate if some one can help me in this matter.

if you are switching from PSW to T2G you will be considered a new entrant and the min pay you need will be £20,500 for a 39 hour week.

The start date in the CoS can be any date between the date of the assignment and up to and including 19/12/2013.

Go back to the solicitor you contacted and ask why she said that you would need to be paid the experienced worker rate.

I asked from her she is saying I'm above 26 and have been working in the same company for 2 years..

ask her to read Appendix J of the Immigration Rules, para 14 (d):

(d) Where both "new entrant" and "experienced worker" rates are stated in Tables 1 to 5, the "new entrant" rate will only apply if the applicant:

(i) is applying as a Tier 2 (General) Migrant and scores points from the Post-Study Work provisions of Appendix A,
(ii) .........
