help

Post by dekon » Fri Sep 20, 2013 10:06 am

Hi all, I need help please.
I am British Citizen, my husband is from Indonesia, currently we are in australia. We only have one and half month until we have to leave the country. ( my husband was working here with 457 visa, but it didnt work out with the employer so we quit ) I want to exercise my treaty rights to Ireland. I have some question, hopefully someone from this forum can give me an answer.
1. What visa should my husband apply, short visit or long term?
2. Can he work in Ireland after I got the job?

Thanks

1. If you want the visa to be processed quickly enough, short term (type C) to accompany spouse EU citizen

2. In theory he can work as soon as you arrive and up to 3 month with no formalities (but this might be tricky as he won't have any official document showing this and employers don't always know this rule). In practice he will have a formal document allowing him to work once you are able to lodge his application for a residence card under EU Treaty Right. Essentially yes it means you need to be able to prove that you are working and both of you are living together in Ireland. You can see the exact document checklist on the application form: http://www.inis.gov.ie/en/INIS/Form%20E ... %20EU1.pdf
His first residence card allowing him to work will be issued 1-2 month after you lodge the application and will be temporary (valid until they have completed the review of his application, which takes 6 months). After 6 months, they will issue a final decision and a 5 years residence card if the application is granted.
