EEA4 application

Post by DVirchand » Fri Sep 20, 2013 11:02 am

Hi

Can some please advise/guide me with my wife EEA4 Perm application

I am a Portuguese and British Citizen (dual nationality, hold both Passports)

My wife is a Indian Citizen (Indian Passport holder). We got married in Feb 2008 in India and she came to UK to join me on 16 Oct 2008 with UK Entry Clearance Visa / EEA Family Permit (EU Route). On 16 Aug 2009 she received EEA2 Residence Card (Non-European family member of EEA).

I think I can apply for wmy wife EEA4 Permanent Residence on 16 Oct 2013?

What supporting documents I should include?

EEA National

1. My EEA ID Card and Permanent Card and photocopy of my British Passport
2. My Employment letter, P60 (six years),

Non EEA Famly memmber

1. Indian Passport
2. Photos
3. Our marriage certificate
4. Her current employment letter

What we need to include for

1. As evidence of residence in the UK by you and your family members both currently and continuously over 5 years: What to submit? I have PR and British Passport? What else from me and my wife is required?

2. Proof of residence: this can include tenancy agreements, utility bills and bank statements.

* Do we need to include Bank Statement for last 5 years?
* Letter from Estate Agent for house rent?

Thank you for your advise

Keep the application simple.

You have PR, you will be expected to demonstrate that you have not broken that by being absent from the UK for more than two years.

Non-EU simply needs to demonstrate residence for five years with you in the UK. Council tax demands for example.

Thank you for your reply

We live with my brother so no Council tax, Bills, etc on our name. Only Bank statements in our name. Do need to submit 5 years of statements?

My wife (non-EEA) been working on and off so some P45 and one P60. Current employement which started 2 months ago..

Bank statements covering 5 years will be sufficient. But the evidences regarding non-eu national activities are irrelevant to application.
