Tier 2 General VISA

Tier 2 General VISA

Hi,

I had been in UK on ICT 2 - Short Term VISA and came back to India early Aug to serve the cool-off period. In the meantime I have got a job offer from an UK company who is willing to sponsor my Tier 2 - General VISA next year once I serve the cool off period.

Now the problem is that the company is asking me to join their India division for the time being until Aug 2014 when they apply for the General VISA sponsorship.

The questions are:
1) If a company is hiring me on the payroll of their India subsidiary, can they apply for General VISA COS for me next year or do they need to go for ICT sponsorship for me?

2) Even though let's say they are successful in issuing an RCOS, would there be any problem during the VISA application?

So if they are licenced for general visa category and not for ICT, they can apply for general visa cos for me - please correct me if I am wrong.

Additionally, during this cool-off period can I apply for Business VISA and travel to UK, if needed? Is that counted under the cool-off period?

Thanks Manci.. so if the company who has offered me a job has got a general visa sponsor licence, then I will be able to apply for general VISA provided they give me the RCOS...ICT is not needed, even though I would be working for their Indian counterpart until Aug 2014 before I am eligible to apply for the General Visa
