Tier 2 ICT Long Term Staff Migrant Extension

Hi,

I got my "Tier 2 ICT Long Term Staff migrant" visa on 28th Nov 2011 and it is expiring on 21st Nov 2013. My company (in India) informed that the visa can not be extended as I have traveled in dispensation model (or net salary model). Now I got an offer for a permanent job from another employer who is ready to provide CoS. Can I apply for switching my employer and extend my Visa?

If my visa application rejected will I get my money back? (the reason is I need to apply extension for my dependents also)

Was your current visa the first T2 ICT VISA you had?

Yes, this is my first work visa for UK, T2 ICT Long Term Staff Migrant. Before that I got one UK Business Visa.

Dispensation model means, we will get 'net salary' of 40k in hand and no need to pay tax. After getting employee's monthly expense bills, company will calculate and pay the tax. We can not extend this type of Visa

This is what my company tells about the dispensation model, but I could not get any reference for this model in UKBA or in Google. Also my company told, they are not processing dispensation model any more.

In my passport, VISA stamping has following details
Place of Issue: CHENNAI/MADRAS
No of entries: MULT
Type: VISA TIER 2 ICT LONG TERM STAFF MIGRANT

Unfortunately you cannot switch to T2G in-country because your initial T2 ICT Long Term Staff visa was granted after 5 April 2011.

As far as the HO is concerned your T2 ICT leave can be extended if you have a new CoS and comply with the requirements.

My case is similar.. I have ICT T2 visa valid for 3 years but employer is saying I can't stay more than 2 years since I traveled under dispensation model.
Doesn't make sense to me. Please help as I can't see any clear guidelines on HRMC site.
