Hi all,

my mate has applied for Spouse visa on 11/03/13 and got refused in May, the reason for refusal being electronic bank statements. He didn't realize he need the official stamp by the bank. So, he appealed in June and got Spouse visa (BRP card) in July.

He got all his documents back except his passport and Marriage certificate. They want to go on their first holiday but because of the above documents missing they're finding it very difficult to plan. In August, he spoke to his solicitor who is an ignorant man and he advised it takes up to 6 weeks to get the documents back as it is with a different department of UKBA. He approached customer service, no luck.

I don't understand why UKBA wants to keep his passport so long when they've issued his BRP card. Can anyone advise what is the best course of action.

But I just noticed it says "If they have requested the return of their passport for identity purposes and we subsequently notice that there is evidence of travel in their passport, we will automatically withdraw their application and their fee will not be refunded."

He needs passport to travel in the EU. Please advise.

That's not relevant to your case...that scenario only applies to pending application! BRP has already been received which indicates application has been approved. So you can go ahead and request for it.
IMpossible is 2 letters to long!

I believe in the October 2013 statement of changes, electronic bank statements are now going to be uniformly accepted.
