Long Term Residence Application - Deadline approaching

Hi folks,

First of all, thank you in advance for taking your time to review my query.

I'm a non-EU married to EU Citizen and have got Stamp 4 since 2008.

My current situation is:

- Stamp 4 expires on 26/09/13
- Applied for LTR in March 213
- Got a letter after two weeks, stating that the process would take up to six months and the deadline would be26/09/13
- As I have not received the decision letter yet, I've emailed them but got the same reply "template" stating that my deadline is 26/09 and I should receive the letter shortly.

My employer has already asked me twice about the new visa.

If I don't receive the letter by tomorrow 25/09, my plan is to go to the immigration office on 26/9 and ask for a visa extension, otherwise, I will be illegal in the country and unable to work.

My question is, do you guys think they would give me a visa extension (let's say one month) until I receive the decision letter? Would they be obliged by law to give me a visa extension based on the fact that they have not fulfilled the deadline requirement?

Did you applied for citizenship aswell? because you're eligible to apply both?

I'm meeting my solicitor today in order to certify the docs so will send the application for Citizenship today.

Any thoughts on the previous post?

You can try but I think the GNIB is unlikely to extend your current residence card without a letter from inis, even if the deadline is passed.

What will probably happen is that if you email the EU treaty right section tomorrow, they will tell you that the decision has been made and the letter is in the post (it is annoying but they always tend to send the decision on the last few days which can cause a small gap for people).

Good luck is all i can say! our case is pretty similar to yours. im an eu citizen my husband isnt. he had stamp 4 for the past 5 years. it expired last friday and on monday we received a letter saying he was refused long term residence. the next day he went to Burgh Quay to try to extend his stamp 4 and he was told that his case is nothing to do with them! he is in the wrong place! the reason they refused him LTR is because they are not "sattisfied" that i was resident in ireland for the past 5 years. the last 4 years are fine but the there is 1 year (between 2008-2009) when i was a stay at home mum with our baby, my husband was working and supporting the family at the time. I sent them my bills, bank statements etc but they simply wont believe that i was living here that year. we lodged in an application for naturalization back in august so we are waiting on decision for that but for now he is without a stamp :(.....pretty mad is all i can say. dont understand why they wont extend his stamp 4

Thank you all for your messages.

After sending several emails to the EU treaty right section as my visa expired yesterday, I've finally received the decision letter regarding my application for a Permanente Residence Card and it's been approved!
