Permanent Residency/Settlement in UK

Post by tojopalatty » Tue Sep 24, 2013 9:18 pm

Hi there,

I came to UK on 4th July 2010 on VISA TIER 2 (ICT) ESTABLISHED STAFF (valid from 24/06/2010 - 02/08/2011). And on June 2011, i got my Tier 1 General Visa. It was for 2+3.

I did my extension on April 2013 (two months earlier than my expiry date) and my visa got extended until Apr 2016. My understanding was that the first year i spent on VISA TIER 2 (ICT) ESTABLISHED STAFF would be considered for PR, so i would be eligible for PR by 2015.

However, closely looking at the criteria for settlement i could see a clause - Tier 2 (Intra company transfer), if your permission was granted under the Immigration Rules in place before 6 April 2010

Does above mean that the initial one year i spent on VISA TIER 2 (ICT) ESTABLISHED STAFF wouldn't be considered for PR? Please can some one confirm?

If the answer is no, my current Tier 1 visa expires when I complete 4 year 10 months in UK as I took extension of my Tier 1 General two months early.

If 4 year 10 months is enough to apply for PR? Or should i do another extension for 2 months or so before applying for PR? Please advice.

Kind Regards
T
