Housing Benefit for husband british & wife indian

Hi
Can you please advice me regarding housing benefit
1. I have British passport and my two son's have British passport but my wife is still on dependent visa
2. Her visa expired on July 2014 and she can apply for Indefinite leave to remain
3. if i apply for housing benefit does she get objection or refuse to Indefinite leave to remain from UKBA

Her leave expires in 2014, it's not expired. You can claim housing benefit, just make sure you're only awarded a single parent/lone parent (family & child elements) applicable amount. In such cases it wouldn't affect her ILR application. Child benefit in your name, tax credits joint names.
