Advice on calculating continuous period

Post by swadhwani » Wed Sep 25, 2013 9:30 am

Hello Team,

I came to UK in Jan'2010 on Tier 2 (ICT) visa and stayed here until Aug' 2010 until got offer from local UK company who provided Tier 2 (general) sponsorship. I went back to India to get the VISA stamping, but my VISA got refused due to not submitting bank statement for 90 days ( i accidentally submitted it only for 89 day). My employer reissued the COS and I again applied for the visa, but this whole process took some time and I got the VISA only in Jan'11 (SO I WAS OUT OF UK FOR 5 MOTHS). I came back to UK on tier 2 (General) in Jan'11 and am here since then.

Summary

Jan'10 - Aug'10 : Tier 2 (ICT) : Total days - 154 which is less then 180 rule
Aug'10 - Jan'11 : OUT OF UK (issue with VISA)
Jan'11 - Jan'15 : Tier 2 (General) - Assuming I'll be here until Jan'15

Question : Do I qualify for ILR in Jan' 15 or not?

Thanks
