HO withdraw their decision

HO withdraw their decision

Hi all,
i was following this board for some months now.
my time line is
applied in Jan 2013
PSW 50K with Team
Refusal in march with no Land line and email address on service contract.
we appealed and got hearing date together on 19th September

when me and my team member reached the court room, Home Office Presetting Officer informed us that he has withdrawn home office decision and they did not follow Evidential Flexibility in their decision.

any idea what happens next?

Your file will be sent back to the Caseworker /team that refused your application. They will have a look at the PO note and make a fresh decision! Good luck .

You just have to wait and your BRP will most likely be send to you soon.

As far as I understand , a case worker will go through you file again and make a decision. Although its very unlikely but still a chance that they can raise some other concerns with your file.
Hence wait and hope for the best.

if the caseworker find any other reason for refusal he will refuse for sure. But after withdraw decision do you have right for appeal as a first time? the section 3c applies and means i can appeal in the first tribunal court or upper tribunal?

Prem,
Same was my case, my appeal was supposed to be August 5th and 5 days to the day of hearing I got a letter from the Tribunal that HO has withdrawn their original decision. Since then till now I haven't heard anything from UKBA. However I am very hopeful because everything work together for good to those who love God.
Be positive you will definitely get your Bio metrics. Congrats!!!

Is a withdrawal good? Can the appellant object to a withdrawal can you not request that the hearing should go on, as it appears to cause delays? People have paid appeal fees which will not be refunded coupled with uncertainties. Perhaps am wrong.

well I dont know whether withdrawal was a good option. I just hope everything goes well now as its been over 6 months now........

Withdrawn decisions is a growing trend now with the presenting officers and doesn't necessarily guarantee success for the appellant. See http://www.freemovement.org.uk/2013/04/ ... decisions/

Unfortunately there's no way to object to the withdrawal...

You don't get any refund because the case did not get in-front of a judge! It's only the judge that can award the fee..So because your appeal was not allowed, no refund.
