Urgent benefits question, all help is appreciated

Post by Lessont » Thu Sep 26, 2013 1:58 am

Hi everyone -

Here is my situation (i will keep it simple)

> I am a British Citizen - 18 years old

> Currently pending JSA, I am not in full time education - but I will be building my own business so please do not judge the JSA!

> My mother has been here for around 9 years or so, her status recently came in last year.. they gave her limited to remain 3 years.. with no recourse to public funds.. I was born and raised here hence why I have British citizenship (i got that last year, i was stateless until then)

We have been doing OK financially for now, but my mums takeaway shop is falling apart due to lack of business, and we are unable to pay the private rent.

My question is, can I include her if I apply for council housing?

Council housing is my best bet, because it is impossible to find a private rent house for myself and my current landlord wont make the contract on me.

Second question is if I do happen to get housing benefit, can I list her as my dependent and claim for 2 bedrooms?

Thank you so much for your help, I have to look after her and I am clueless on what to do!

Firstly your mother should write straight back to the Home Office explain that she's due to exceptional circumstances, hardship and the welfare of a child should have been given access to public funds. Also request that it is changed now to allow access to public funds as per Home Office guidance to avoid destitution.

Does she have any other children? What Country is she native? Is she healthy? Is she divorced/widowed?

Hi there, your response is deeply appreciated.

I will write back to them immediately, any ideas which department I should address it to?

I am her only child, she is divorced, but she was never "formally" married - my father left when I was child and it has been been just me and my mum for a very long time so is seen as a single parent

Native of Turkey, and she is healthy.

She is lucky as she is a native of Turkey she can claim public funds so no need to change the visa type just quote page 23 of the guidance (click).
