Hello,

Could someone please advice me on whether I should mention in my application the separate addresses that we are currently living in.

I am aware that the legal right to resign is still valid unless we are divorced BUT we are still in civil partnership.

You could succeed if you live seperately, but you will need to show that the person is exercising treaty rights in the UK, and was doing so for the preceeding 5 years leading to the application, or any five continuous years, provided they did not leave the UK for continuous 2 years since the 5 continuous years of treaty rights.
