Tier 2 dependent visa application

Hi,

I'm a PhD student in the UK under Tier4 visa. My husband arrived to UK with a Tier 4 dependent visa. I recently got a job in the UK and I need to change my visa to Tier2 (General) category. My husband's visa expires in Feb 2015.

I know that when I change my visa to Tier2 my husband needs to change his visa to Tier 2 dependent as well since he is my dependent. We don't have the required savings to do it at the same time for both of us. So I'm planning to apply for the visa first and then my husband will apply after 3 months so that sufficient funds could be shown for him.

We want to travel to our home country in 2 months time. I want to know if there would be any immigration issues if I have a tier 2 visa and my husband has a student dependent visa while travelling? We could argue that we will be applying for his visa after coming back from our home country. But I'm not sure if there will be any issue.

Does anybody know about it?

Ask your T2 sponsor to certify maintenance, then neither of you will need to show any maintenance funds and both of you can apply at the same time (which is cheaper). The sponsor just has to tick a box when they assign the CoS and there is no financial outlay for them - it is merely a guarantee that should it be necessary they will maintain you for 1 month.
