British citizenship or permanent residence?

Post by feliteodor » Fri Sep 27, 2013 4:57 pm

Hello, guys
new here on the forum, had a look around and couldn't find anything similar to my case, so here it is:
- i'm a Romanian that came to UK in 2006 with an au-pair visa
- in 2007 got my blue card(registration certificate)
- worked since 2007 as an employee on the basis of no restrictions given by the blue card
- have got P60's and payslips for 6 years(September this year just had 6 years of employment)
- because of various reasons, i didn't apply last year for my permanent residence
My question now: according to UKBA, EEA members acquire automatically the residence after 5 years and it's not compulsory to apply for it, like those for ILR.
Do you think that i can now apply for citizenship on the basis that i've exercised the EEA treaty rights for 6 years? Also i will take the life in the uk test.
I have quite a large folder of bills, paperwork to prove my residence and employment for the last 6 years, like i said before.
Any opinions on this one?
Thank you

Jambo, I've got to say you made my day, mate! I knew that I was right when reading about the subject on UKBA, looks like I can apply straight away for citizenship...
that is once I pass the life in the UK test. Have got it booked for Monday lunch time, will post the result as soon as I take it.
Wish me luck, guys and hope to bring you some good news Monday! All the best and thanks again Jambo!

Great news, guys!Just passed today my Life in the UK test, a bit nervous when i took it, with all the new material in the 3rd edition.Proved to be easier than i thought, even though i'll admit, what most people tend to say it's true: READ THE BOOK!!!No matter how many tests you do online, you still need to go through the book at least once. That's what i did.And to mention, i started studying a week ago, so it's not really that hard after all , even with all the new dates and characters they added in this year.
Also, to top it up, i sent today a letter to HMRevenue, asking for evidence, history of my tax and employment for the last 5 years.Link here for those interested http://www.hmrc.gov.uk/industrial-compe ... /index.htm
Jambo, you've been a great guy and helped me so much, can i ask you some more for your opinion?
My case is: i hold a Blue Registration Certificate(only for Romanians and Bulgarians), that states that i am free of any restrictions on employment from 19.06.2007.From this date until 20.10.2007 i worked as an au-pair and didn't pay any taxes, so my very first payslip is dated 20.10.2007.Question is: i will have exactly 6 years on 20.10.2013.Should i apply before this day, just because i don't want to end up doing the language test from 28.10 this year.I know i should be exercising treaty rights for 6 years, but i do know also that as an EEA citizen you can stay in uk for 3 months without actually working, then you need to look for a job or start work.I still have my au-pair contract extended in 2007, but don't know if i should actually consider it, as i wasn't paying taxes when on that job. What do you think? I am taking a risk here?
Most grateful, as always, for your wisdom you show us here.
Thank you. A pleasant evening.

Have got p60's ,letters from employers to cover 6 years of exercising treaty right (i do not have a permanent residence card). My question is: my very first payslip, a weekly one is dated 28.10.2007. What date should i apply to UKBA, after the 28.10 or i can earlier, given the fact that i was working from the 24th of that month, so 6 exact years would be on the 24th?
Any ideas, anyone?
PS: i was in the UK from 2006, so i was physically present on any of those dates.
