Child tax credit while husband is abroad

Post by jinkazama_11 » Sat Sep 28, 2013 4:32 pm

Hi
I need some clarification re my situation and child tax credit. Every time I ring tax credit help line they give me different information.

Here is my situation
I am working and my wife doesn't work and look after kids, I got 3 kids and older is 4 years old. Our child tax credit claim is joint, we don't get much but every little helps.

I will go to another EU country for at-least 6 months and will be working there. I will be coming home (UK) for only once a month.
I think our joint tax credit claim will stop. My question is

Can my wife claim as single person? If yes what she have to say in "Partner" section of claim form?

Thanks for your help

See Your family isn't in the UK - help with your tax credits claim (click)

I assume your spouse will have the right to reside whilst you are abroad.

Yes she is a British citizen.
Thanks for the link. But non of the scenarios match our situation, does this mean we wont be able to claim at all.

In our situation.
I will be working overseas.
My partner and kids will be in the UK.

Thanks

As CTC is a family benefit under Regulation 883/04 it may be that you can continue to receive the tax credits as a couple whilst your spouse is working in another EEA Country. Although, HMRC guidance seems to indicate that the child must also move to the EEA Country. You should seek advice from the CAB as they have access to a specialist support service. If not, then the tax credits should be paid at the same rate for 8 weeks then a single claim would need to be made.

Thanks for the information. I will contact CAB.
