hello All,
Please I am new to the forum and I need some advice, my case is, I am British living with my unmarried partner (non EEA), we have be in the relationship for 2yrs now,and will are blessed with a 8mths old baby.
he came to UK with a student visa, later applied for extension (tier 4) to finished his program but refused. but he still went ahead to finally graduated june 2013, while waiting for there reply.
We applied for family live to remain. but refused. I need advice please

We can't guess so you would need to cite the full and precise reason for the refusal as detailed in the letter.

REASONS FOR REFUSAL:
1)He is in Uk illegally (visa expired in May 2012)

2)We are not married under UK LAW and do not have evidence that we are living together for two yrs ( fail to meet E-LTRP1.2 and GEN1.2)

3)they acknowledge his genuine and subsisting parental relationship with his son, but it is not a mandatory requirement according to them.

4)you do not have sole parental responsibility for your child

Being in a relationship is not the same as living together akin to marriage. If you can't show the necessary proof over a two year period, it is not possible for the application to be approved.

That is your only remedy as the decision confers no right of appeal, as it is not a removal decision and you partner did not have an extant leave when he made the application.

If you have been in a relationship for 2 years and it is documented, I cant see hiw marriage can be a game changer.

I believe the game changer may be Section 55 of the UKBA act 2009, which was either not considered or not considered properly.
