US citizen married to UK citizen with child- catch 22

Post by Englican » Sun Sep 29, 2013 9:25 pm

My wife is a UK citizen and we have a child born in the US. We have been married 5 years and currently live in the USA. We want to move back to the UK, but I am caught in a catch 22 in that it seems in order to get a Visa, I need to already have job in the UK, but of course no employer in the UK will even look at my CV or application if I do not have a Visa.
Any advice on how to break this catch 22?

You could consider applying for entry clearance under the points based system (Tier 2). This will of course require you to find a job with a UK based sponsor and a willing Tier 2 sponsor would of course accept that you do not yet have a visa. Alternatively your wife would need to come to the UK, obtain employment and then you would need to apply as a spouse for entry clearance. Your wife will need to bear in mind the financial requirement for such an application.

Do you have any savings? Has your spouse been employed in the US? Consider also the EEA route (click).
