Spouse Naturalisation - Date squeaze, need advice ...

Hi all

I have just become a british citizen after naturalisation and am looking to apply my wifes as a spouse of british citizen, but there is a tight squeeze due to booked travel just around the dates she becomes eligible:

She meets all other requirements but the residence which will be met end of this month as detailed below:

-> First came to UK as Tier1 Dependent, arrived in UK on 31st October 2010
-> Extension FLR(M) followed by ILR on 10th Feb 2013
Spouse (myself) gets citizenship in September 2013
-> Will complete 3 years on 30th October 2013
-> Plan to apply in NCS on 29th October 2013 such that application will reach home office on 30th October 2013 .
-> Travel out of UK booked for 3rd November 2013, i.e. the 5th day after applying at NCS.


:arrow: Since the travel is already booked for 3rd Nov, is it safe to have the NCS appointment on 29th Oct due to the 5 day clause set by NCS ???

:arrow: That said is my statement correct that my wife will complete her 3 years on 30th October 2013 since she arrived in UK on 31st October 2010 ???

There is no more 5 days rule for NCS. This was changed last July. She doesn't need to be in the country when the application is recieved. She is still required to have been in the country at the beginning of the 3 years.

She will also need to meet the new English requirement.

Thats a great news really, cos everywhere I read on board I saw the mention of 5 days after applying at NCS.

Presumably those were posted before the change.

Yes. It would be valid. I just wanted to point out there will be no issue if the application (from whatever reason) is received a few days later.
She has a degree taught in English comparable by NARIC, guess that should take care of the new english requirement, am I right ???

A quick question around Section 3 in the application form an (After having read the FAQ):

My wife is a shareholder in my Limited company so what should I mention as occupation for question 3.1 ? would it be investor/ business partner ?

Also for question 3.2, should I tick Business Partner or Selfemployed ?

And since she does a self assessment for the dividend she receives, I presume we need to mention tax office reference number as well ???

I don't think share holding is considered employment. I don't see why she would need to declare that. The HO could anyway access her tax records directly if they wish.

So do you recon to put 'Housewife' for the first question and leave rest of the employment section blank ? And that should be alright ?
