I am a British Citizen and do have a GF who has been in the UK since 1999,but she had a break of residence between 2006 - 2008,she went back home to participate in the national service of her country.She has been back for 5 years (did her Msc and also got the IGS visa),presently studying in a college.

The underlying issue is that I am going through a divorce proceeding right now. We did breakup before she left the UK in 2006 and I moved on and married someone else,who gave me a divorce on the same day,we returned from Croydon (got her ILR). So cannot rush into marriage again.

Can I apply as an unmarried couple (FLR(m) and would there be a problem if I leave the UK to take up a role in Africa but she remains here?
Would the Visa be curtailed?

Are you saying that your marriage was a sham? Did you orchestrate that or were you unaware?

I was unaware.. Had my doubts but thought it was the "toothing" period of marriage. Guess I see the point now,why the probation period of 5 years is wise. Anyway,life has to move on.

Well remeber if you find out that s(he) was previously married that may be enough to get their ILR revoked. Yes, it's awful when people do that, horrid. I would investigate that avenue in a hope to get the marriage annulled.

Funny,you should say that.. A new bf just appeared on the scene. But I just want to leave any memory I have and forge ahead.

So with the situation,I stated about the unmarried visa,please what do you advice..
