EEA Route for Dependent Widow Mother (surindar singh route)

Post by CH » Mon Sep 30, 2013 3:34 pm

hi,

I'm a British citizen, currently employed in the UK. My mother is Pakistani national and is living in Pakistan. She is a widow and is financially dependent upon me. I've been regularly sending her money for last few years and do visit her 2-3 time in an year.
She is aged 54 and has a son and daughter in Pakistan(daughter married living in a different city and son is currently un-employed and is moving to another country). I wish her to live with me permanently in the UK. Based on immigration rules in the UK, getting her dependent visa requires proving exceptional compassionate circumstances, and chances of getting the application rejected are quite high. I'm inclined to adopt the Surrender Singh route, i.e. to live and work in the Ireland (or some other EU country) for three months, and then apply for her dependent visa, once she come to Ireland and get her family permit, I can move back to the UK where she should get 5 year stay as a dependent of EU citizen.

My current plan is to move to Ireland, register a company and start my business. My current employer has offered me to work remotely rather than quitting the job. I might need to visit office occasionally. I'm finding this an excellent option to have some backup for monthly expenses until my business kick off.

Have a few queries:

Q1. Do I need to declare my British job at any point?

Q2.If yes, then do my employer need to pay me at my Irish address, or I can keep getting my wages on my UK address(I plan to keep a residence in the UK for occasional visits)? any tax advice??

Q3.Any extra documentation/confirmation from employer is needed to prove this remote working arrangement? Can I do without it?

Q4.Would it be a good idea to bring my mother in the UK on visit visa and take her with me to Ireland and then apply for her dependent visa there? Without an Irish visa, being dependent of an EEA national, would she be considered Legal if she go and reside in Ireland (going by road without encountering Irish border control) OR is it better that she do apply from Pakistan.

Q5. How long is the process of obtaining her dependent visa once I’ve completed three months in Ireland.

Q6. what are her chances of getting the visa

Q7. And once she land in Ireland, how long she must stay before she can travel to the UK when I permanently move back to the UK?

Q6. In above mentioned situation, can British border control create any problem considering that I had been employed in and visiting the UK frequently?

Please note that keeping my mother with me is unavoidable, I either would have to move to EU or Pakistan permanently. Any advice that can help in this situation would be greatly appreciated.

Thanks,
CH
