Which EU court ruling

Which EU court ruling was it that essentially said that the non-EU spouse, need not be legally in the country of residence, while applying for an EU-FP.

I have it some where, but can't think of the name of it.

Found it,

It was the Metock case.

If your non-EU spouse has followed you to a EU member state, and her visa expires, then her is still legally resident in EU - Schengen.
