EEA FP visa questions

Post by kenota » Thu Oct 03, 2013 8:43 pm

Hi everybody,

We are currently getting through EEA FP application form and we are confused with questions on the application form. There are questions about my (EEA national) salary, questions if we lived together, and so on. I read a lot of topics on this forum, btw you are doing really great job to help everybody, and in many occasions people are saying that you can answer "n/a for EEA FP" on such questions. Is that true? If yes, on which questions we can answer that?

I am asking because of our story: I am Lithuanian and also Russian. My wife is Russian from the same city in Russia I lived in, before I moved to London 2 years ago. We met in London summer 2012 when she was staying here on business visa. After she left, I started visiting her in St. Petersburg almost each month for 1-2 weeks, then we celebrated 2013 New Year in Finland with her parents. We got married this august.

Now, my only concern is not to receive refusal based on "marriage of convenience" grounds. Because we cant provide any bills in both of our names, we have photos, my tickets to st petersburg, wedding photos, photos from honeymoon and log of almost daily skype calls.

Also, FAQ topic in this forum mentions that form should be brief and for EEA FP only couple of conditions should be met, thats why I am wondering is it safe to skip some questions in my situation? I understand that nobody knows for sure, but I hope that somebody might have similar experience here.

The form is a copy of that which is used for immigration rules applications. The last time I looked is that it dates from Dec 2008. The requirements for EEA family permit are very straight-forward.

Non-EU's Passport
Evidence of EU's nationally (passport copy)
Evidence of relationship to EU (eg marriage certificate)
Statement from EU national that they will be accompanying or joining EU national (if EU is already in the UK, evidence that they are a worker, student, self-sufficient).

Sometimes there are problems. Sometimes ECO fails to apply the law. Sometimes they take extra information provided and use it to make a case against the applicant.

If an application is refused, there is the possibility of an appeal.

EUsmileWEallsmile, thank you for your answer. Am I understanding you correctly: the required set of documents is very limited and providing extra information can be potentially harmful for application?

The requirements are limited indeed. Inconsistencies in documentation submitted, perceived or otherwise have anecdotally led to refusals, so have misapplication of the law.

Just quick update. We successfully got EEA FP and it took less then 1 week. With our application we also provided cover letter, photos of our marriage and our common photos during different time of our relationship.

I want to thank everybody on this forum, I spent some time reading different topics and got a lot of useful information here. You are doing really good job.
