Tier 2 - ILR eligibility

Hello All,

I got my Tier 2 visa in May 2010 and landed in UK on 2 June 2010.
I believe the forms I used for my Tier 2 application were March 2009 VAF09, and the process of getting my work permit through my employer started in Mar 2010. Would I be eligible to apply for ILR, since I am not sure as to whether the new rule got implemented on 6 April 2010 or In April 2011. Any help would be greatly appreciated.

are you on T2 ICT leave and, if so, when did you apply for the visa? Is your visa T2 Established staff?

Hi yes, I am T2 - ICT Long term staff.
My COS aasignment date is 13 April 2010, but the process by the employer was commenced in Mar 2010.
I beleive I applied for my visa sometime in April 2010 (definitely after 6 April 2010) and got it in May 2010.
I also got a 3 year extension of my Visa in May 2012, so my currenty vailidty is upto may 2015.

Unfortunately you will not be eligible for ILR as your first visa was in the T2 ICT Established Staff category

Ok. Thanks. My visa says its ICT long term staff rather than
Established staff, is that the same ?

Also, would I be eligible to extend the ICT post
May 2015, after I complete 5 years.

your first visa which you obtained in May 2010 would have been as T2 ICT Established Staff.

You will be eligible to further extend in 2015

Sorry for the piecemeal questions,
But could you let me know for how long will I be able to extend and what are the relevant conditions ?
Is there a cap on the maximum time which I can stay in the UK.
I have some knowledge that we can also apply for ILR
After 10 years ? Is this still valid and is it applicable to me, assuming I am able to extend my Tier 2 ICT visa.

under current rules you are eligible to extend your T2 ICT leave indefinitely. See para 192 of the T2 policy guidance:

Also under current rules you would be eligible for ILR after 10 years lawful residence but who knows what the rules will be in 2020?

if you switched to Tier 2 General you would be eligible for ILR in 5 years from the time you switched, however, you would need to change sponsors.

I have one more question. My Wife and son are my dependents under my current Tier 2 Visa. Would they be eligible for ILR after 10 years alongiwith me ?
