DRO and naturalisation - need to declare?

Post by harvardgrad » Fri Oct 04, 2013 11:59 am

Hi
I am applying for naturalisation very soon. I have been discharged from a DRO via the insolvency offices (not through court) and have read different things. Some say that you need to declare it as a civil penalty, others that as it was through an insolvency office you don't need to declare it on form AN.

Anyone know categorically whether it must be declared or not. I don't want to hide anything, however if there is no need to declare it, then I'm not going to invite problems.

Thanks in advance for answers

Did you receive any CCJs on your debts?

DRO and naturalisation

Does the fact that i have had no CCJ's mean that there is no need to declare a DRO through the insolvency offices that didn't go through the courts?
Thanks

You'll be on the Individual Insolvency Register it may be wise to wait until the DRO is discharged (12 months). Although, technically it is not a bar as per the Guidance. However, it could be viewed as you have deliberately/recklessly built up debt with no intention of repayment. If you do apply, I would declare it and write in the extra information how you lost your job, became unable to repay and were advised to do a DRO by a debt charity (assuming all that is the case) all pointing to circumstances beyond your control making you unable to pay the debts.

Thanks so much for taking the time to the reply. I am no longer on the insolvency register as DRO is fully discharged. So, I should tick yes to the civil penalty section? Thanks

No it's not a civil penalty or CCJ. As it's discharged it may not be necessary to mention it. However, if you do in extra information, explain how it was beyond your control I.e. Not intentional or reckless.

Hi
just found out that i've been approved for British citizenship without any problem regarding recent debt relief order which i declared in the extra info section...( 5 years indefinite leave to enter Uk).
Hope this helps someone else..
Thanks for all the help and good luck to others ;)
