ILR Qualification for Tier1 and Dependent Rule for Extension

Hi

I have a got couple queries and wondering if anyone can help me out in this regard.

1- Eligibility for ILR

I had attained my Tier1 (General) visa on 3rd November 2008. I was on Post study work visa for one year before Tier1 General. I applied for Tier1 during my post study work visa within UK and then went back to my home country to gain some job experience. Afterwards I got the approval letter for Tier1 so came back to UK on 17th October 2008 to get Tier 1 visa (my post study was still valid that time to come back to UK). After obtaining my Tier1 i went back to my home country to fulfill my commitments related to my job on 14th November 2008.

Finally i moved back to UK on 20th March 2009. Afterwards whenever i went back to my home country they were part of my annual holidays from employement. Below is the list of my absence from UK.

1- 14th November 2008 to 20th March 2009 (130 days)

2- Mar 2010 to Apr2010 (22 days) Part of Annual Leave- Letter from employer obtained

3- Mar 2011 (20 days) Part of Annual Leave- Letter from employer obtained

4- Feb 12- Mar 12 (18 days) Part of Annual Leave- Letter from employer obtained


My current Tier 1 visa is expiring on 3rd November 2013. Based on the calculation of days above Can you please guide whether i am eligible for ILR as long as i apply between the dates of 17th Oct 2013 to 14th November 2013 as this was the period i was in UK five years back? Your help will be really apprecaited in this matter.


2- Visa for Dependent

My wife dependent visa is also expiring on 3rd Nov 2013.
My wife came to UK as my dependent for Tier1 (Genaral) in May 2012 so she has to complete two years before she is eligible for settlement. My query is in case if i am eligible for ILR as per case above which form do i need to fulfill for her extension? Will it be PBS dependent form or will it be FLR (M). Can i book the premiuim appointment for her with me with category ILR with dependent or do i need to book a separate appointment for her after i get my ILR . Then this mean getting ILR first for myself and then afterwards book appointment for her for extension?

Also if are applying under FLR(M) does this mean she has to provide English language proof? I am ok with it if we need to provide it as she has completed her Masters with recognized institution back home. My query here would be whether we need to provide NARIC 'satatement of Comparability' or will the points based calcultor list of universities be enough proof as her university is on that list. Then in that she only need to provide her original master degree certificate.

Your quick response will be really appreacited in this matter.

Hi,

I am also going for ILR on 8th NOV'2013 and my wife has not completed 2 years by then.

So I am taking one appointment for myself on 8th as SET(O) form and for my wife on 13th Nov'2013(that I am not sure if I am allowed before I received BIO-Metrics card .. .??)

Next regarding the form For dependent who has not completed 2 years needs to be PBS (Tier1/Tier...general)Dependent form . You can see on website...

I called to HOME OFFICE customer service and they advised me to take separate appointment and PBS form for wife..

You can also call HOME OFFICE(08706067766) and confirm all details..


1) I had my BIO metrics done during last TIEr 1 extension but still Need to check whether approval letter they provide you after ILR VISA processing is successful is enough to show for wife's VISA appointment next date or need to wait for ILR card to reach you ????

Please let me know if you get any details..

And by the way Just to know..which location you are applying ..

Hi

I book appointment based on SET O for ILR for myself and PBS dependent for my wife on the same day. My appointment was earlier than her and i told the case worker that other appointment related to my wife is dependent on the outcome of my application. But they were taking each case individually. So when other case worker called for my wife case we told the same thing to them. They case workers cordinated with each other and decision was hold until my application got processed. Once i got the approval letter case workers handling my wife case handed over her sucessful application back after half an hour. So all goes well for us in our cases as we got decisions on same day and saved lot of time to arrange appointment for another day for my wife.
