Hi,

I entered the U.K in Aug 2007 from India under student visa for 1 year college education. I enrolled in Uni in 2008 and got further entry clearance till FEB 2011.

I got married to a British citizen in Jan 2011 and had our first child in NOV 2011. Relationship started deteriorating after that and we finally split in June 2012. I was initially offered contact with my child and then mother refused contact in October 2012. I applied to courts for a contact order and mother made several allegations of domestic violence in counter application. I am still in the process of getting a contact order.

I travel frequently for business and when i was returning from trip in FEB 2013 I was asked about my relationship at the airport. I let the immigration officer know that my marriage has broken down and I am waiting for an outcome on contact order. My passport and resident card was kept at at airport and I was issued an IS96 TA.

I then contacted a solicitor for help who made and application under zambrano principle in MAY (my resident card was expiring in end may).

I was issued with a COA with a right to work and business. Last week my application was refused on the ground that I am not the primary carer of my daughter and if I leave the U.K there is no reason that my ex and my daughter cannot continue their lives here.

I have another court hearing in later in October for contact order with my daughter but if I decide to leave U.K i will never be able to play my role in my daughters life. I understand that it can take further 8 to 10 months before a contact order is made.

Are there any grounds on which I can extend my stay to get contact with my daughter?

I have my own business and can show an investment of £50,000

Please any help would be appreciated.
