ILR - Continuous Period + New English Language Requirements

Hi everyone,

My sister (main applicant) and her husband (dependant) are nearing their ILR application and we've come across a few questions.

They applied under HSMP on 17 March 2008 and got their approval letter on 27 July 2008. They then applied for visa under Tier-1 (General) (they needed further time to maintain funds for three months) and got their visas stamped 22 December 2008. They entered the UK on 28 February 2009. Their current extension expires on 17 January 2014. During their stay total time they have stayed outside the UK is less than 180 days and no one stay has ever been 90 days or more. Both have traveled outside the UK together.

Now the questions below considering they apply for ILR at the beginning of January 2014:

1. We're assuming they are eligible to take advantage of the rule to be able to apply within 90 days before completion of their 5 years? Please let us know what concerns could be raised, if any?

2. My sister scored 7.5 in IELTS with her initial application; does she need to provide proof of English language afresh with her ILR application?

3. Her husband is an MBA from Allama Iqbal Open University, Islamabad, Pakistan and the degree is taught in English. Is there any concern if he tries to get comparability for Level B1 from NARIC for his degree? Or should he just take any other test (e.g. IELTS)?

Please let me know if any further information is required to clarify the situation and I'll try to get back as soon as possible.

Any help/clarification for above questions would really be appreciated.
