I'm dual Australian/Irish national.
Resident in UK since 11 November 2008. (Ancestry Visa in Australian Passport)
I obtained Irish nationality in 2011.
I'm wondering about the following requirement
'You must be free of immigration time restrictions on the date of application, and have been free of immigration time restrictions for the twelve month period before making the application'
As an EEA national am i considered free of immigration time restrictions? So ILR wouldn't be required?
As a Commonwealth citizen, born in 1978, with British parents and grandparents, i could also apply for Right of Abode. Would this meet the requirement for being 'free of immigration time restrictions?'.
ILR looks expensive and complicated so hoping that i can use Right of Abode or EEA nationality instead. I've been working full time since arriving in 2008 so no issues with treaty rights etc and have no long absences from the UK.
My husband is a non-EEA national on an EEA2 Residence Document, when applying for Right of Abode or ILR could he apply as well?
Any advice would be greatly appreciated - i'm almost at 5 years residence and want to make sure i make the right application.
