PLEASE HELP ME MY IMMIGRATION STATUS IS COMPLICATED.

Post by BIOSme » Tue Oct 08, 2013 10:03 pm

My father is a British citizen and I came to UK at the age of 26 years as a student. In 2007, I went back to my country to visit my grand mother was the one that brought me up when my father left for UK and she said I should stay with my father when I return back to UK because her extended family are threatening her regards an inheritance. When I returned back to UK and discussed this with my father who thought my granny was joking.
My grand mother was attacked on January 2008 and she later died in the hospital.
I consulted a solicitor and I was advised that I can apply as an dependent under my father which I did but my application was refused and I was given right of appeal. I appealed against the decision and the judge said he believe I wanted to stay in UK because of the comfort I found with my father.
I received another letter from Home Office to leave the country or I can apply to take the case to High Court. I filled in the high court form and fax it back to the Home Office and since then I have not hear back from them.

I finished my studies and now have 2 children but I am not together with their mother.

Since Home Office have not contacted me in regards to the last application I faxed. I see myself as an over stayer.

Please advice me on the way forward.

Thanks

Was your father British otherwise than by descent when you were born?

Was he married to your mother?
