Any suggestion to when my PR will be due?

Post by mescapon » Tue Oct 08, 2013 11:38 pm

Hi Guys I am a newbie and have been reading your post and advise and was wondering if anyone has any advise for my situation....

My current status;
-I am a non EU family member of an EEA
-Arrived UK - July 2007 on Student Visa from 2007 July - August 2009
-Got married to EU national - July 2009
-Given EU Residence document; Feb 2010 - Sept 2010 (Family member of an A8 national on WRS) [HO advised that my partner had to register for WRS]
-Given another EU Residence document; Dec 2009 - Dec 2015 (Residence card of a family member of an EEA national)

My Wife(EU national) was self employed from (Jan 2007 - Jan 2009)
Employed in a company from ( Feb 2009 - Present)

My question is will I be able to apply for EU family member PR or ILR by July 2014 (I would have been married for 5 years by then)

Or can I apply directly for an ILR on the basis that I have been in the UK for over 6 years (Legally & working)

Or does my 5 years start counting from when I was issued the second visa (Dec 2009 - Dec 2015) or did it start counting after I got married (July 2009 - July 2014) ?

Thanks in advance..

you can only apply for PR July 2014 under EU rules
UK Student Visa : 04/2004 - 09/2009
EEA Residence Card : 07/2010 - 7/2015
EU Settled Status: Confirmed on 16th July 2019
Naturalisation : Confirmed on 02nd Oct 2020
Passport Approval : 21st Feb 2021

Thanks for your reply

I just noticed that I made a mistake in the date mentioned above

My current status;
- I was given another EU Residence document; Dec 2010 - Dec 2015 (Residence card of a family member of an EEA national)

And I want to know if I will still be due for my PR July 2014?

Cheers

you can apply for PR 5 years after marriage even if you never had a resident card

As an EEA national family member does not require posession of a Residence Card to prove their right to reside and their right to work in the UK
UK Student Visa : 04/2004 - 09/2009
EEA Residence Card : 07/2010 - 7/2015
EU Settled Status: Confirmed on 16th July 2019
Naturalisation : Confirmed on 02nd Oct 2020
Passport Approval : 21st Feb 2021
