Tier 1 Dependant - Serious matter

My brother have Tier 4 student visa and he wants to switch as Tier 1 General Dependant as his wife has tier 1 visa.
As per new rules from 1st Oct 2013 he can switch, as one of his friend recently switch to Depedant visa, but his Tier 4 visa will expire in end of Jan 2014. Somebody told him he must have 6 month valid visa to switch into Dependant route.............is it right?
does he need to give any proof of cohabitation as well?
he and wife were living apart because of both were working different cities.but now they are together for 2 months.

I don't think that is a requirement of 319C. Do check to make sure.

He should prove that their marriage is subsisting.
