ILR scenario - family not in UK

Post by bygodsgrace » Fri Oct 11, 2013 4:35 pm

Hi All,

I am a married, Tier 1 migrant with two children. Let me try to explain my situation.

I, Main applicant - eligible for ILR - Tier 1 visa valid till March 2016

Wife - will be eligible for ILR if she stays in UK for four months more - not in UK - Tier 1 dependant visa valid till March 2016

Elder child - eligible for ILR - not in UK - Tier 1 dependant visa valid till March 2016

Younger child - will be eligible for ILR with my wife - not in UK - Will apply for Tier 1 dependant visa in December 2013

My query is as follows:

If I apply for ILR or change my visa status to ILR now, Can my family (wife and 2 kids) travel to UK with the Tier 1 dependant visa still or do they need to get a new visa?

Thanks in advance,
Aks
