Spouse Visa Refused

Spouse Visa Refused

Hi

I had the Spouse visa refused, due to financial requirements, on the application I entered the wage after tax, instead of before tax.

Do you think I could appeal as if they have counted the wage before tax then i would've met the financial requirements.

and If I want to submit new application can I use the same documents again or are they too old? The visa was refused in April 2013

If the wage before tax was 18,600 or over, and the sponsor has been earning that for over 6 months, then you could appeal. rather than making a new application, and paying new fees. Alternatively you could ask the ECO for reconsideration.

You have to appeal within 28 days. Far too late now. Re-apply.

Unless there are exceptional reasons for a very late appeal e.g. you've been in a coma you'll have to reapply with new documents making sure your application is completed correctly this time.

Now I've been employment more than 12 months and earn various monthly amount depending on overtime.

do I apply under Cat a non-salaried employment and & Cat: D cash Saving

my gross profit in last 12 months was 14500 plus savings of 28K.

Cat A, if your last 6 months gross wage / 6 x 12 = £13800 or more or use:

Cat B if not (looking at the last 12 months income), you'll need to supply 12 months wage slips with Cat B and 6 with Cat A along with the other specified evidence as per Annex FM 1.7. 5.6 page 31.

Cat D tariff income will be 28000-16000/2.5 = £4800 PA.

Total assuming no dep children would have to equal or exceed £18600 PA Gross.

I dont think the Cat B can be used, as the income is 14500 before tax, and have savings of 28k in last 11 months, the wage various on monthly basics
