Help with ILR from Tier-1 G with absence around 35 days

Post by happyguy82 » Sun Oct 13, 2013 4:39 pm

Hi there,

There's a period while I was on Tier-1 G when I was absent from the UK for over ~35 days in a year. 1 of the absence was back to my home country for 27 days.

This is more than the standard Annual Leave allowance. I work through an umbrella company so although I'm a PAYE employee, I only get paid for the days that I work. Thus there's no real 'paid annual leave'. I'm not self employed as the company is my legal employer.

I have asked the company for a letter evidencing that I was away on annual leave but they sent me a formal letter confirming I was employed from DATE A -> DATE B, and in the body it says "we do not comment on our employee's annual leave activities".

How will this situation affect my ILR application and how should I approach it in section 6.3?

Thank you very much in advanced.
