EEA2 Application & Tier 1 PSW Visa Card: Submit Card?

Hello.

I am applying for the EEA2 Visa this month. I just married my Belgian husband who is working in the UK. I currently have a Tier 1 Post-Study Work Visa (I was one of the last ones who was able to get it before it was scarpped.)

I was able to obtain a second US passport (2 year instead of 10 year) so that I could travel for work during the application process. (If you can prove that your passport will be taken for the visa application process, you can get a second passport from the US embassy.)

Because I am on the Tier 1 PSW visa, I have been advised to apply for the EEA2 (no need for EEA1 since I'm already here and working.) However, looking at the EEA2 application, there is no mention of submitting my Tier 1 PSW visa card. I am assuming I should submit this with my application to show why I didn't need to apply for the EEA1. However, I will need this card with my second passport if I want to re-enter the UK. And I need to travel to mainland Europe for work with cleints.

So I am a bit stuck. Am I to submit my Tier 1 PSW visa card with the EEA2 application or not? The application only states to submit my passport, but I don't want to get rejected based on not providing my visa if it is needed.

Any help is appreciated- thanks!

EEA1 : EU national

EEA2 : NON EU national


- Your and husband passport

- Husband exercise treaty right in the UK

- Marriage certificate

- Proof of address for both after marriage ( i assume you living together )

- And a nice cover letter

don't need to send any other documents ; in the EEA2 application even if you stay at home it doesn't matter but EU national must be doing something..


exercising Treaty rights for EU national:

employed or self-employed; or
studying; or
economically self- sufficient (meaning that you have sufficient funds to support you without requiring public funds); or
a jobseeker; or
retired; or
someone who has had to cease working in the UK owing to permanent incapacity.

I understand that UK Immigration don't care what I'm doing for work. I thought they would care how I am in the UK already (and that I skipped the EEA1 application.)

Say, for example, I came in as a tourist instead of the EEA1- that would not be OK. But I was already here as a student, then a Tier 1 visa holder/ worker.

So I thought I should probably show that this is the reason I am already here. I understand that the application states I do not need to provide anything but my passport, my husband's passport, our marriage certificate, my husbands work papers/ work contract, ect. But I just want to make sure that I am able to show/prove why I am already here and "skipped" the EEA1. Maybe I'm thinking too much about this- but in my experience having applied for my student visa and then the PSW Tier 1 visa, this wasn't the case.

it doesn't matter what you doing now. As long as you have valid leave to remain and you are legal resident in the UK

you can send both EEA1 and EEA2 together

EEA1 : To be used by European Economic Area (EEA) or Swiss nationals residing in the UK and their EEA or Swiss national family members.

You husband will get a registration certificate ; it is completely unnecessary. why pay extra £55 for it?

EEA2: To be used by non-European Economic Area (EEA) or non-Swiss national fam- ily members of EEA or Swiss nationals residing in the UK.

I'm sorry but you are confusing me.

First you say I should apply for the EEA1 and EEA2 together, then you say it's not necessary and just apply for the EEA2. But my original question is still unanswered.

I was told that the EEA1 was not necessary. I am just wondering about my PSW Visa card.

Could you please explain more clearly what it is you advise I should do? Do I need to apply for the EEA1? Can I actually sumbit the EEA1 and EEA2 together? And yes I am here legally, but to PROVE that it would be best to show my Tier 1 PSW Visa card to do this. Hence I am back at my original question. are you an EU national? no you are not so EEA1 is not for you. EEA1 is for your Husband. He can apply with you if he want but not necessary.

so, that's why i said You can send both EEA1 and EEA2 together. meaning your application and your husband application together. very few EU national apply for EEA1 . I don't see any reason they need to apply for one

Who issued you PSW .. Home office right? so , they already know who you are and you are sending your passport with EEA2 application form

You are mixing some terms - EEA1 is for EEA nationals. What you referred to is EEA Family Permit which is applied from outside the UK.

As for your question: there is no need to send your Tier-1 PSW BRP with the application. There is no need to show you have a valid visa when applying. Under EEA regulations rights are obtained automatically (if married) so you are legal already. What you are applying for is confirmation of this right. This is different from the Tier-1 visas in which you need first to ask permission from the HO.

If you are married with a EU national who is a qualified person then you should not worry about much of tier 1 visa as long as you have a valid (unexpired) passport. And applying EEA1 is totally optional but if you want to send it then at the cost of further £55 you can send it along with EEA2 application in same envelope with same (1) set of evidences/documents. Although EEA1 is optional but because it usually process more quicker, therefore, it can tell the outcome of EEA2 application more quicker too.
