Child born in Pakistan

Post by shazman » Mon Oct 14, 2013 6:03 pm

Hi There,

I am applying for ILR and my current status is Teir 1 General. My Son born in Pakistan and he is on Tier1 Dependent Visa.
My Question is do I need to include him in my application for ILR or can we get him Registered directly after our ILR.
Our yonger boy born here in UK- What will be about him if both comes under different rules.

My apologies if its been already asked. I could not find this scenerio so posted here.

Thanks much in advance.

Where is the other parent and what is his/her status?

The child born in the UK would not need leave but rather has an entitlement to register as British on form MN1 by virtue of section 1(3) BNA as soon as you have been granted ILR.

Thanks much Amber.
She is on Tier 1 General Dependent. Am I right in guessing then we need to include the elder boy in the ILR application.

A child born outside the UK will be expected to have ILR for registration by discretion under section 3(1) BNA.
