Entry visas for Germany: non-EEA family member of a Brit Cit

Post by chaoclive » Thu Oct 17, 2013 6:52 pm

Hi there

I recently asked the German Embassy in Beijing about the possibility of getting an entry visa for my Chinese civil partner (I am British).

The first reply I got was:
"Can you briefly clarify for us: For how long does your partner want to
travel to Germany? Are you only asking about short term visits while you
look for work? Or are you asking about longterm resettlement after you
took up work in Germany?"

Is it correct that if I want to plan to Germany to 'look for work' and actually do find a job and decide to stay there, there will be no consequences for my partner? It seems that the German Embassy here apply different rules depending on whether we apply for a short visit visa or a 'resettlement' visa.

As I am considering working in Germany, but will not have anything set up before I get there, will applying for a short visit visa be ok? After I get a job, can I still go ahead with residence card process etc?

Thanks for any thoughts!

You should definitely apply for the short stay visa (Schengen), the Germans are spot on about the directive, it doesn't matter what initial visa you had, you can go ahead in Germany with RC application when you meet the requirement.

Apply for the normal tourist visa, which serves as an entry visa. The directive 2004/38/ec applies.
