Quick Question on FLR (M) Extension

Post by SAbramson » Sat Oct 19, 2013 9:09 pm

Visa Expired August 19th, Sent extension August 16th. All went through except when they tried to charge my Debit Card, I was using a different debit card because my card snapped in half. They sent back my packet (Mid September) asking for a different payment method and to resubmit. (Nothing about having to leave or quit job or anything.) So 2 weeks later, I bought postal money orders and resubmitted knowing they would have the money. So within the last couple weeks I have received my information to get my Biometrics done and everything and the paper saying my application is being reviewed.

A.) Am I still allowed to work? This has me nervous as I do have a very decent job, but my job is with a very well known employer. They have been getting quested from HR if I am still allowed to work. As far as I knew as long as my application was in, and it was processing I could still work.

Anyone have any answers to this?

Thanks!

P.S. I am here on a Spousal Visa.

Why are you extending? When did you arrive in the UK and when did your last leave expire? Payment failure alone is not a reason to refuse an application so your working status should be ok. Employers can contact the ukba and ask them, it's not difficult and they should know this.

I arrived May of 2011? expired August 2013. I am extending because When I went to take my Life in the UK test, I put my full name, and my Provisional doesnt have my full name so I was refused. So I decided to extend another 2, and prep longer for my test.

If there is a problem can you be fired? Is your employment on hold?

2 more years for the LIUK test :? Moreover, you'll also be subject to the new B1 requirement, if I were you I'd get the LIUK test done now and get ready to submit SET(M). Technically your application shouldn't have been refused due to fees alone, it's got to be proven to be invalid. However, if the UKBA has the application down as out-of-time that may cause trouble for employment. You may be able to vary FLR(M) to SET(M) if you complete LIUK now.

Honestly not worried about B1 requirement, I am American, I think I already meet the requirement. My Application wasn't technically refused, they sent it back and said resubmit with a current payment card.

Ok in such case, your right to work continues and your employer should verify this with the UKBA using their simple system, not ask you.
