Can I apply for ILR 3 months before the date I complete 10yr

Please help me guys....this is doing my head in! I will appreciate all the knowledge I can get so my application is approved. Here's my story....

I came into England on 24th Aug 2004, and had student visa until 2010 where I applied for the Highly skilled worker Tier 1 and was given 3 years. Which expires in April 2014! Meanwhile by Aug 2014 I would have been in England for 10 years! Now my questions below....

1. Can I apply for ILR in April even though I will be 10yrs in August which is 3 months ahead?

2. If no, any advise on what I can do to buy time till August?

3. What do I need to have a strong case?

4. In between I traveled to my country in 2011 for 5months+ cos of depresssion, no job etc

5. I'm going to my country again for 6weeks anx will be back by second week in Jan 2014


PLS HELP ME....

April to August is 4 months!

You can apply for a pbs extension by post before your current leave expires, then vary a valid application to SET(LR) from 28 days before you qualify, assuming a decision is not made.

So long as you left with leave and returned with leave and the absence was <180 days, that should be ok.

Total absences should be < 540 days over the 10 year period.
