What do I apply for ?

Hello guys,
my x wife and I were here under a work permit, she was the main application and I a dependent.

We are now divorced separated and have a 5 year old daughter who lives with her mum.

What do I apply for and what points ? A solicitor says FLR(O) Further leave to remain as a parent exercising rights over a child, private life and human rights( Should be my strong points ). But when I read on the UKBA website, my x or daughter are both not settled.

We have a court date in November for contact order, since my x is being difficult and my leave expires soon, she has renewed has, and been here since 2005, I have been here since 2007
