MN1 Section 1(3) Query

Hi

My daughter is 2 years old. She was born in the UK but have been living in India since she was 4 months old.I have got my ILR in June 2013.Now I want to register her as a British Citizen under section 1(3) and then want to apply for her British passport. She has never entered in the UK. Can I apply for her BC registration on the basis of her Birth Certificate and my passport and my BRP.

One more thing...Can I apply for her British passport in the UK while she is in India or do I need to go to India for applying for her British passport.

You need to register her as British Citizen using MN1 first.

Hi
I checked the link you mentioned...It'll take around 6 months for the whole process i.e..
Applying for Registration under MN1 - more then 1 month..
Then applying for British passport takes 16 weeks... 4 months..

Could you please tell me any visa or some other option to bring her here ASAP... I have been looking to get my daughter here ASAP...its very urgent for me....Please help!

Register her as British and then apply for a CoE(usually takes 4 weeks). Or apply for ILE if she is eligible.

Thanks....

Her passport was issued in London so I would like to apply for COE from inside the UK.So that I can take her COE to India and then bring her back with me.

Can I do so OR if she is India my parents have to apply from India.

Sorry for so many questions.

Technically it should be made where you are, however, I doubt it will make much difference. It may be quicker in India with the new change coming into affect I'm not sure how busy they'll be in the UK.

Hi

As I am applying under Section 1 (3). Is it necessary to have Father's consent in Section 6: Consent to the Application.

He is away these days.

I can provide my Passport, BRP and my daughter's Birth Certificate.
Are the above documents enough for my application.[/b]

I phoned up Weybridge NCS center but the are only processing applications upto 31 Oct. What should I do now?

Both parents should consent to the child being registered as a British citizen.

You can send the application in yourself without using the NCS, send via special delivery and get certified copies if you want to keep documents.

Hi

I looked for ILE eligibility on UKBA but didn't get enough information for supporting docs.
Could you please let me know that how a person can be eligible for ILE.

Actually, for section 1(3), both parents do not need to consent.

Although I agree it is only a legal requirement for 3(5) and 4D that both parents sign, guide MN1 states:
page 29 wrote:For other types of application we require the consent of all those with parental
responsibility for the child. If only one parent has consented, please explain why at section
6.3. If it is not convenient for one of the parents to sign the form, consent can be provided
in a separate letter. If the father of an illegitimate child is making the application, we would
expect the mother to have consented.
Therefore, if both parents can easily sign (or consent on letter) then I think it may be wise to do this.
