Pls advice (judicial review)

Please advice me I came as a visitor in 2005 and applied for ILR in 2012 and was refused.i applied for judicial review on family life and welfare of my child and argue on her well being,she's got a health condition (disability)which affects her a lot and could hardly walk,she depends on me on daily basis,she's EEA national got it through the dad.but resides with me.been waiting since 4months now for judge to decide on the case,what could be my chances.thanks
