PSW 50K Route Appeal Hearing tomorrow

Hi there
I have got the appeal hearing 24 Oct. My barrister will be there with me. Unfortunately, my solicitor said my barrister will not do argument with me? That is very strange!!!Is there anybody in same situation?

I refusal reason are
1. the ads did not feature my name
2.the service undertaken on my contract was a direct copy from the NQF framework.

I need more suggestions.

Is your business currently trading?

For the ads that did not feature your name, you can argue that standard organisations only include business name on ads and not directors name, you can also say that your name is already on the business card.

For the service issue you can add that for clarification purposes and also to be in line with Home Office guideline, you decide to use the same format.

Yes, my business is still trading.
Do you know is it necessary that my barrister will do argument for me? If not, I am not quite sure why I need to appoint him.

your lawyer would have booked him for the hearing only, your lawyer should have asked you if you wanted a meeting before hand to come across where you could discuss weak aspects within case as it costs a client extra money but it is worth it, your lawyer will have a meeting with your barrister it is called counsel where your lawyer will brief your barrister about the case just before the hearing on hearing day and that is it.

ask your lawyer if he could arrange you a meeting with barrister before hand its really really worth it.

Your lawyer should be able to give you the reason why your barrister wont be arguing on your behalf.

As your business is trading, you should take along all the evidence of trading to the hearing as the omission of name on ads shouldn't be a major reason for refusal and hopefully the judge will give judgement in your favour.

Make sure your service is also as stated so that you can argue that your business is as stated on the contract and reason given by caseworker will make no sense if you render services directly copy from the NQF framework.
