Dependent of Tier I (General) ILR application 2 year rule

Post by Hariprasad99 » Thu Oct 24, 2013 1:41 pm

I am applying for my ILR in March 2014. My wife got her dependent visa on Jan-12 which is valid till 18-Mar-14 (i.e. more than 2 years). But, she entered UK only in 5-May-12. So, she will have 48 days short from two years.

Would she be eligible to apply for ILR with me as the gap is only 48 days and her visa was valid for more than 2 years?

Thanks

Assuming you're a PBS applicant for ILR. It's a risk, perhaps more cautious to apply by post for an extension and vary to SET(O) when eligible.
