My wife got her EEA - FP a few days ago, and now we are in UK :)

How long have you spent in Germany before applying?

Hi,

We were in Germany for just over 3 months, registered and then unregistered from the town hall when we left for our trip to Dunkirk.
I worked for 12 weeks.
We rented an apartment together..
I worked for 12 weeks, and I got 1 week holiday.
Then when we arrived Dunkirk and asked fro the A1 stamp, they all but laughed us out the place, saying I needed to work fro 6 months to exercise treaty rights.
In short, they chased us away.
So we went to Calais, and had a bit more success, but still refused to grant my wife UK clearance, again deny all knowledge of the stamp.
They said we must get an proper EEA-FP.
So we went back to our temporary hotel, and filled in the application fro EEA-FP via the World Bridge application center.

We then had to go to Paris, where my wife submitted the documents, and then had her biometrics taken.

8 days later, we got a refusal :(, the refusal was that was not a worker

So we reapplied same day, on line again, via world bridge, and we got an appointment for next day.

So next thing for us to do was to print out extracts, to prove thet I was a worker, this was taken off the UKBA website, under Swiss and EEA nationals.

So we doubled the documents, but they were mostly various case law etc.

Then about 9 days later, we got the text message to come to Paris, to collect our documents.

And there was the EAA-FP in her passport.

As I am a UK national, she is given the right to work, but it doesn't actually say that on the visa sticker.

Do she, or should she complete the EEA2 form, and shell out £55 ?

Does some one have any valuable links to documents, that confers that she has the right to work in UK please.

Did you get any of the refusals in writing? I would like to know where 6 months is written

As they agreed now your wife qualified there is no requirement to apply for further confirmations of her right of course persauding an employer is the next challenge. We got the stamp (now "expired" lol) at port which was accepted as such proof backed up (eventualy ) by the employers check line after I intervened the company has asked for a further update and Ive printed various docs that confirm no requirement for an eea2

The "6 months" was given to us verbally, which I knew was total bull crap.
This is why it was never written down on the refusals.

So back to the EEA2 thing.

When I read the EEA2 guidance it becomes as clear as mud ! (not surprising)

It reads,

1/ WHO CAN APPLY ON THIS FORM.
Non-EEA or non-Swiss national family members of EEA or Swiss nationals, exercising Treaty Rights in the UK. can apply for a residents card on this form.


I recently exercised my economic treaty rights in Germany for 3 months, and as such, my Chinese wife was granted an EEU-FP, which is entry clearance to UK.
Her EEU-FP is valid for 6 months, from last week.
We are now in UK for almost 1 week.
So does she need to put in an EEA2 application?



So here lies my confusion.
I am not exercising my economic treaty rights in UK, I exercised my 3 months economic treaty rights in Germany.

From the UKBA website.....
What should you send with your application?


When you make your application, you must provide:

the fee of £55 for each person applying
your valid passport;
the EEA or Swiss national's valid passport or identity card;
evidence of your relationship to the EEA or Swiss national; and
2 passport-style photographs of you.

You must also provide:

evidence that the EEA or Swiss national is currently exercising European Treaty
rights in the UK, if you are applying for a residence card or a family member
residence stamp - the page explains what European Treaty rights are; or
evidence that you have a right to permanent residence, if you are applying for confirmation of that right.

The EEA guidance notes contain more information about the evidence required. We have also produced a checklist which can help you decide what evidence to provide. You can find this checklist under 'Related documents' on the right side of this page.

We will return your documents using Royal Mail 2nd class post.
Processing times

The time taken to process your application will depend on the type of application you make and how you submit it.

We deal with all applications within 6 months. Some applications will be resolved much sooner.

The language of the form is intended to the vast majority of applicants which are for non UK EEA families. The rules are different for UK citizens using the Surinder Singh route. You are not required to exercise treaty rights on your return. Read Q5 in EEA FAQs - Common Questions - Read before posting - Surinder Singh for more details.

They (UKBA) don't make the forms easy to understand.
But any way, I begin to understand the points now.

I can see the form is intended for the "non-UK" persons coming to UK to exercise their treaty rights here, just like I did in Germany.
