Right time to apply for naturalization

Post by Perfect 4 » Fri Oct 25, 2013 7:30 am

Hi experts,
I was granted entry clearance visa on 18/02/2008 and I landed in the UK on 15/03/2008 and I got ILR on 01/02/2013 . Can anybody let me know when can I apply for naturalization the earliest?
Many thanks

Assuming you are not the spouse or civil partner of a British Citizen, then 01/02/14 note, you'll have to have been physically present in the UK, 5 years prior to the Home Office receiving your application.

as you mentioned 5 years prior to the application received, can you please make me clear these 5 years are counted from the date you are granted entry clearance visa or you landed in The UK.
Thanks

Two separate issues, one that you have had ILR for 12 or more months and two, that you were physically present in the UK 5 years before the Home Office receive your application.

For example, if the Home Office received your application on the 05/02/14, then you would have had to have been physically present in the UK on 06/02/09.

can you please explain which date is considered to count the period for 12 months of ILR, is that the date when we appear for ILR interview and told that our application was successful or the date mentioned on biometric card?
Thanks

The date in which is on your BRP - valid from. The only time when an earlier date should be considered is where the case was protracted at no fault of your own. In your case a PEO same day decision would not be protracted.

I was looking at my Bio metric card it says valid from 08/02/2013 and it expires on 01/02/2023. Now as you see it expires exactly after 10 years of the date when I appeared at PEO not from the date bio metric card is valid from. Does not that mean ILR is counted from the date of approval? Please suggest.
Thanks
