Visa being curtailed. Urgent!

Post by hungvu271 » Sat Oct 26, 2013 12:55 am

Hi guys, I hope you could help me with my case.

I am a master student at a University in London ( starting in sep 2012 and expected completion in sep 2013), currently on Tier 4 student visa which will be expired on the 17th Jan 2014.

During my exam back in May 2013, I accidentally had my phone with me ( although switched off), when I went to the bathroom, an invigilator asked to disclose if I have any items in my pocket, which I took out my phone and wallet. To make it short, the university has made me retaken all exams in 'resitting out of attendance' mode ( as the university classified such action was a serious assessment offense). That it, I now have to retake all exams in next academic year in 2014. As I have more than 60 days before the visa expires, therefore the school has notified the UKBA that I am no longer student at the University and the university has ceased sponsoring my visa on the 29th July ( the university said I got 60 days to leave the country). However, the UKBA has not notified me yet, all the matter with visa curtailment has been communicated to me by the university itself only. I am currently still in the UK ( it has now passed the 29th September which was the date the University told me to leave the UK) and I wonder in case of visa curtailment, is it only valid if the UKBA itself wrote to you and said specifically when you have to leave the country? I still have to come back to the UK in May 2014 to retake the exams and just wondering if i am currently staying 'illegally' in the UK or not?

Any help or advice on this matter is greatly appreciated. Thank you for reading!

As your CAS has been terminated/finished/cancelled, you have no rights to be in UK anymore.

So your stay is illegal now, if not, soon it will be! And it will destroy all your immigration history with UKBA. You should contact Home Office or leave UK at your earliest.

It's worrying that you are waiting for UKBA to actually contact you even though the University already informed you about the curtailment. You're walking a thin line here and all your future applications will be at risk of refusals for overstaying your leave.

In my own opinion, I will try to leave as soon as possible (You dont get stamped on the way out of the country anyway) before Home Office actually trying to issue you removal notice. Good luck

my dear, as long as home office did not sent you any curtailment letter, your stay may not be illegal in UK.
if you want to continue stay in UK, you may do fresh application on another course and study part time current course. to advice you i need more information, how long have you been studying in this country or email me with all of your details?
Home office curtailment does not mean you have to leave the country..you are eligible to make fresh application by following UKBA Policy guidence.
